What are the five judgments in this sample?
Five judgments drawn from the records Sovereo tracks, each with its evidence. The full edition adds a chart and what changed since the last quarter.
- 1. Trade for investment is now a template, and it is not yet law.
On 15 January 2026 the US and Taiwan concluded talks that capped US tariffs on Taiwanese goods at 15 percent, in exchange for at least US$250 billion of direct US investment by Taiwanese companies and US$250 billion in Taiwan credit guarantees. The agreement was signed on 12 February 2026. A Federal Register notice of 28 May 2026 says it is not yet in force.
Sources: Baker McKenzie, 20 Jan 2026; Federal Register 91 FR 31818 - 2. Deals priced on tariff relief now carry legal risk.
The Supreme Court struck down the tariffs imposed under emergency powers (IEEPA) on 20 February 2026. A Section 122 tariff followed and expired on 24 July 2026. Taiwan now faces a 10 percent rate on certain goods under a Section 301 action that Taiwan describes as not final. The relief a partner buys depends on which legal authority survives.
Sources: Fortune, 20 Feb 2026; Focus Taiwan, 24 Jul 2026 - 3. Technology companies are entering US banking through federal trust charters, and the banks are suing.
Circle received final OCC approval for a national trust bank on 10 July 2026 and Ripple on 26 October 2026. A community bank trade group sued the OCC on 2 October 2026 (No. 1:26-cv-03441, D.D.C.). The next fixed date is 18 January 2027, the latest date the GENIUS Act stablecoin rules take effect.

The House passed the Stop Insider Trading Act 232 to 198 on 22 July 2026. In the Senate the vote to start debate failed 53 to 47 on 30 September 2026, seven short of 60. Pending bills expire when the 119th Congress ends on 3 January 2027, so disclosed trades remain the only public record to set against committee roles.

China's October 2025 rare earth export control package, including a review of chip-related uses at 14nm and below, is reported suspended until 10 November 2026. Whether it is extended is not confirmed. A lapse would test every chip supply chain built outside Taiwan, Arizona included.

Opening file: what did Taiwan trade, and what did it get?
Taiwan traded a chip build in Arizona and state credit guarantees for a lower US tariff and better treatment for its chips. TSMC's Arizona commitment grew from US$12 billion in May 2020 to US$265 billion in July 2026, about 22 times the original plan.
Stage and status
- Stage
- 4, Operating: TSMC's first Arizona fab has run N4 in volume since late 2024. The government agreement is at stage 3: signed, not in force.
- Status
- Advancing, with a legal question over the tariff authority it rests on.
- Lane
- Sovereign capital, with links to AI capital and minerals.
Who wants what
- US government
- Leading-edge chip production on US soil, and leverage over allies through tariffs.
- Taiwan government
- Lower tariffs, favorable Section 232 treatment for chips, and a stronger US commitment to its security.
- TSMC
- Keep its largest customers supplied, avoid tariff exposure, and hold its technology lead.
Who controls the outcome
TSMC controls process technology and the pace of capacity. Washington controls tariff rates, Section 232 treatment and subsidies. Taipei controls outbound investment approvals and the credit guarantees.
Who concedes, who pays
Taiwan moves part of its "silicon shield" abroad and underwrites smaller suppliers with state guarantees. The US gives up some tariff revenue. Arizona carries water and power strain. US chip buyers are likely to pay more per unit than for Taiwan-made supply. This is Sovereo's assessment, not a reported figure.

What triggers the next move
- 10 Nov 2026
- China's rare earth control suspension lapses unless extended.
- Open
- Entry into force of the agreement, and a vote in Taiwan's legislature.
- Open
- The final Section 301 rate on Taiwan.
- Jan 2027
- TSMC's 2027 capital spending guidance at its fourth-quarter earnings call. Date not yet announced.
- Q3 2027
- Fab 2 volume production on N3.
What would kill it
The tariff authority behind the relief fails in court or lapses, so the partner pays for relief it does not get. Taiwan's legislature declines to ratify. The overseas margin drag grows past guidance and TSMC slows the build. Rare earth controls choke materials for fabs outside Taiwan.
Who it affects
- Family offices
- Arizona industrial land, housing and supplier demand around the fabs; exposure to Taiwan's strategic premium, which erodes slowly rather than in one event.
- Operating companies
- Chip buyers' unit costs; any partner country weighing the same trade with Washington.
- Real asset holders
- Water and power in central Arizona.

Capitol Signal
Disclosed trades by members of the committees with jurisdiction over commerce, defense and China policy, in the companies most exposed to this deal, are checked against committee activity under a fixed method. A flag is a signal, never an accusation, and never a trade idea.
